2016 Tundra Crewmax SR5 Upgrade 38 gal tank??

There is a 38 gal tank on my spec sheet with my VIN on it.  ( I just bought this)   My salesman said for sure it has the 38 gal tank.   Just took it to my LOCAL Toyota dealer and talked to this unfriendly guy who told me there are no 38 gal tanks in California.  It's a 26.  He was very blunt and wasn't interested in anything else I had to say.   Is this true?  Do I need to take this back?

I have a 2016 tundra and it has the 38 gallon tank. its an sr5. i think its the convenience package upgrade
