Got a 2003 CLK convertible, The top can be open , but the back latch will not close. However, it does close when the top is up. Can anyone explain why?

Have a 2003 CLK, have not open the top for a while.  Now it can be open, but
the back latch will not close.  However, when the top is back up, the back latch
can be closed.  Can it be repaired or reset?  Is there any place near the Irvine
area that can repair it?
