Toyota Hiace automatic transmission

My 1991 Toyota diesel hiace van doesn't shift gears when I put it in Drive first thing when it is cold.  Second and first gears work.  If I pull over and restart my van  the shifting works fine.  I just changed my ATF and filter.   Am I doing more damage to the transmission if I keep driving it?  Any suggestions on problems?

I replaced the transmission fluid and filter after I was getting these symptoms to see if it would help. I will check the fluid levels again. It only seems to happen when its cold and not every time. The mechanic suggests that it would require a rebuild but doesn't have the equipment to test a transmission on a right hand drive. Wondering if there are other diagnostics available before I go down that expensive road.
